Contracts

All legitimate contracts have three elements, offer, consideration, and acceptance. This results in a mutual agreement.

Any so called agreement or contract that I sign that does not have consideration, i.e. has a clearly defined benefit for all parties to the contract, is signed under duress. If I am forced to sign a document to earn pay for my work, the ability to trade of my labor for pay is not consideration. And because I need to earn money to live, the signing of any document that I have to sign to work is done under duress.

If a contract cannot be negotiated or altered by me, there is no mutual agreement. And therefore the contract is signed under duress. Any agreement signed under duress is not legitimate. I will treat any such agreement as illegal, and an attempt to wrongfully control my behavior.

What follows is the Terms of Service for my website. I offer you the use of my website in exchange for your agreement to be bound by the terms below. If you would like to negotiate these terms, please contact me using my contact form.

This contract has all the elements of a legitimate contract, I have offered my website for your use, in exchange I request you follow my Terms of Service, and if you use my website without asking to negotiate these terms, that is acceptance of the contract.

Digital Signatures

Digital signatures, in email, over HTTP, or in person, must be unreputable, and verifiable beyond a reasonable doubt. That requires a cryptographically secure method for signing and verifying the signature of a document. For this system to be valid, it must be linked through cryptography to the document signed.

I, Elliott Stoddard, have several hardware backed methods for digitally signing documents that meet these requirements. One of these is backed by a soverign nation, and validates the date and time of signature with their servers, as well as a hardware backed digital signature.

Any digital signature that does not meet the above standards is repudiated by me, Elliott Stoddard.

Allegations of Misconduct

I, Elliott Stoddard, strive to conduct myself according to the highest standards of lawful and ethical conduct and to comply with all Idaho and US laws. While I, Elliott Stoddard, endeavors to adhere to all applicable laws, I follow the Non-Aggression Principal (NAP) and requests that those interacting with me do the same. Laws that criminalize actions and possessions where there is no victim are not laws at all, and violate natural laws which are superior in every way.

I, Elliott Stoddard, treat allegations of violation of this policy seriously and will take all steps necessary to investigate and address allegations of misconduct. Please report all allegations to me in writing at the address below or by using the contact form. I will investigate the allegations, and if they are valid, I will publicly post a report of my findings.

  5. Any breach of license by a user will result in a penalty of 1 ounce of gold (or spot value) per occurrence, to be paid to Elliott Stoddard within a calendar month from the date of occurrence.
    1. The late fee for any penalty will be a doubling of the penalty every calendar month the penalty is late.

Restricted access

Access to certain areas of this website is restricted. Elliott Stoddard reserves the right to restrict access to areas of this website, or indeed this entire website, at Elliott Stoddard's discretion.

If Elliott Stoddard provides you with a user ID and password to enable you to access restricted areas of this website or other content or services, you must ensure that the user ID and password are kept confidential.

Elliott Stoddard may disable your user ID and password by his sole discretion without notice or explanation.

Entire agreement

These terms and conditions constitute the entire agreement between you and Elliott Stoddard in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.
